Terms of Use
Last updated 13 October 2026
These Terms of Use ("Terms") are an agreement between you and Nicholas Campbell Malcolm (ABN 70 610 323 411), trading as KIDS ("KIDS", "we", "us", "our"). They apply to the KIDS iPhone app, website and related services (the "Service"). By downloading, accessing or using the Service you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service. Please read section 1 carefully.
1. Important: KIDS is not medical advice
The Service provides general information only. It summarises what published research and public health guidance say about claims circulating about children’s health. It is not medical, health, nutritional, psychological, safety or other professional advice, and it is not a diagnosis or treatment of any person.
Using the Service does not create a doctor–patient, clinician–patient or any other professional relationship between you and us. We are not health practitioners, and the Service does not consider your child’s individual history, symptoms, circumstances or needs.
Always seek the advice of your GP, paediatrician, pharmacist, maternal and child health nurse or other qualified health professional about your child’s health. Never disregard, delay or stop following professional advice, and never start, change or stop any treatment, medicine, vaccination, diet or safety practice, because of something you read in the Service.
If you think your child may be seriously unwell or in danger, call 000 immediately or go to your nearest emergency department. For health advice at any time, call healthdirect on 1800 022 222. For poisoning, call the Poisons Information Centre on 13 11 26.
2. How fact-checks are made, and their limits
Fact-checks in the Service are generated automatically using artificial intelligence. Our systems identify claims trending in news, search and online discussion, search medical research databases and public health guidance, and use AI models to produce a verdict (for example "Supported", "Mixed" or "Not supported"), an evidence-strength rating, a summary and a list of sources.
Automated checks are used to test whether cited sources were retrieved and whether summaries are consistent with them. Fact-checks are NOT reviewed, approved or endorsed by doctors, nurses, researchers or any other health professional, before or after publication.
AI-generated content can be wrong, incomplete, out of date, oversimplified or misleading, and automated checks will not catch every error. Research and guidance change over time and may not be reflected in the Service. A verdict summarises a body of evidence; it may not apply to your child, and the absence of a claim from the Service says nothing about whether it is true.
You are responsible for how you use the information. You should read the cited sources and speak with a qualified health professional before acting on anything in the Service. Sources are provided for reference; their inclusion does not mean the source’s author or publisher endorses KIDS or our summary.
If you think a fact-check is wrong, use "Report a problem". We may review, correct, update or remove content at any time, but we are not obliged to respond to every report or to keep any fact-check current.
3. Parent votes
Vote results show the opinions of people who use the Service. They are not evidence, not a scientific survey and not a measure of what is true or safe, and they may not represent parents generally.
You may cast one vote per claim using your own account. You must not attempt to manipulate votes, reports or rankings, including by using multiple accounts, automated tools or coordinated activity. We may remove votes or reports we reasonably believe are not genuine.
By voting or reporting, you allow us to store your vote or report and to use and display it in aggregated, non-identifying form (for example, the percentage of parents who agree).
4. Eligibility and accounts
You must be 18 or older to create an account or make a purchase. The Service is intended for parents and carers and is not directed at children.
You can read some content without an account. Counting votes and reporting problems require signing in with Apple. You are responsible for activity on your account and for keeping your device secure.
You can delete your account at any time from the account screen. Deletion removes your votes and reports, as described in our Privacy Policy.
5. Acceptable use
You must not: use the Service unlawfully or to harm anyone; copy, scrape, crawl, harvest or bulk-download content; use the Service or its content to train or build other AI models or competing products; reverse engineer, decompile or interfere with the Service or its security; access it by automated means; misrepresent KIDS content as professional or medical advice, or as endorsed by any health professional or organisation; or use the Service for commercial purposes without our written permission.
We may suspend or end your access, remove content you submitted, or refuse service if we reasonably believe you have breached these Terms, to protect the Service or other users, or where required by law.
6. Purchases
Some features may require a one-time in-app purchase. Prices are shown in the App Store before you buy and include GST where applicable. Purchases are processed by Apple, and Apple’s terms of sale and refund processes apply. We do not receive or store your payment details.
A one-time unlock gives you access to the features described at the time of purchase for as long as we operate the Service. It is not a subscription and does not guarantee any particular amount of content, any specific claims, or that the Service will continue to be offered indefinitely.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law or other law that cannot lawfully be excluded, including any right to a remedy for a major failure.
7. Changes to the Service
We may add, change, suspend or remove features or content, or discontinue the Service, at any time. We will try to give reasonable notice of significant changes that affect paid features, and any rights you have under the Australian Consumer Law are unaffected.
The Service may be unavailable from time to time because of maintenance, failures or circumstances beyond our control.
8. Intellectual property
The Service, including its software, design, text, fact-checks, verdicts, compilations and trade marks, is owned by us or our licensors. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service on Apple devices you own or control, for your own non-commercial use, in line with these Terms and the App Store’s usage rules.
You may share links to fact-checks and quote short extracts for personal, non-commercial purposes with attribution to KIDS. If you send us feedback or suggestions, you allow us to use them without obligation to you.
9. Third-party services and content
The Service links to and relies on third-party content and services, including research papers, health websites, Apple, RevenueCat, Supabase and AI providers. We do not control and are not responsible for third-party content, availability, accuracy or practices. Your use of them may be governed by their own terms.
10. Our liability
The Australian Consumer Law gives you guarantees that cannot be excluded, including that services will be provided with due care and skill. Nothing in this section limits those guarantees or any liability that cannot lawfully be limited.
Subject to that, and to the maximum extent permitted by law: (a) the Service and its content are provided "as is" and "as available", and we make no other warranties or representations, express or implied, about accuracy, completeness, reliability, currency or fitness for any purpose; (b) we are not liable for any loss or damage arising from your reliance on content in the Service, any decision you make or do not make about your child’s health, care or safety, any error or omission in AI-generated content, or any third-party content or service; and (c) we are not liable for any indirect or consequential loss, or for loss of data, opportunity or goodwill.
Where our liability for a failure to comply with a consumer guarantee can be limited, and the Service is not of a kind ordinarily acquired for personal, domestic or household use, our liability is limited, at our option, to supplying the services again or paying the cost of having them supplied again. In all other cases, and to the extent permitted by law, our total liability to you in connection with the Service is limited to the greater of the amount you paid us for the Service in the 12 months before the claim and A$10.
Our liability is reduced to the extent any loss is caused or contributed to by you, including by acting against professional advice or these Terms.
11. Your responsibility
You agree to compensate us for any loss, cost or liability we reasonably incur as a direct result of your breach of these Terms, your misuse of the Service, or your violation of any law or third-party right, except to the extent the loss was caused by our own negligence or breach.
12. Disputes and governing law
If you have a concern or complaint, please contact us first at nick@0xlaunch.me so we can try to resolve it. If it isn’t resolved within 30 days, either of us may pursue other options. This does not stop you contacting a consumer protection agency such as NSW Fair Trading.
These Terms are governed by the laws of New South Wales, Australia. Each party submits to the non-exclusive jurisdiction of the courts of New South Wales and courts that can hear appeals from them.
13. Apple
These Terms are between you and us only, not with Apple Inc. ("Apple"). We, not Apple, are solely responsible for the Service and its content. We are responsible for any maintenance and support of the Service to the extent required by these Terms or applicable law; Apple has no obligation to provide maintenance or support for the Service.
You must comply with any applicable third-party terms, including Apple’s App Store terms and usage rules, when using the Service.
If the Service fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) for the Service. To the maximum extent permitted by law, Apple has no other warranty obligation for the Service. We, not Apple, are responsible for addressing any claims relating to the Service or your use of it, including product liability claims, claims that it fails to meet legal or regulatory requirements, consumer protection or privacy claims, and intellectual property infringement claims.
You confirm you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and are not on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
14. General
We may update these Terms from time to time. If we make material changes we will notify you in the Service and, where appropriate, ask you to accept the updated Terms. Changes will not apply retrospectively to purchases already made in a way that reduces your rights.
If any part of these Terms is invalid or unenforceable, it will be read down or severed to the minimum extent necessary and the rest will continue in effect. Our failure to enforce a right is not a waiver of it. We may transfer our rights and obligations under these Terms to a successor operating the Service, provided your rights are not reduced. These Terms and our Privacy Policy are the entire agreement between you and us about the Service.
